In September 2023, the United States Equal Employment Opportunity Commission (“EEOC”) filed a lawsuit alleging that Enterprise Leasing Company of Florida, LLC (“Enterprise Florida”) engaged in a pattern or practice of age discrimination by failing to hire applicants age 40 and over for Management Trainee positions during the time period January 1, 2019, and December 31, 2023, in violation of the Age Discrimination in Employment Act of 1967 (“ADEA”). Enterprise Florida denies the allegations in the Complaint and denies that it violated the ADEA. The EEOC resolved its age discrimination lawsuit against Enterprise Florida via monetary settlement of $1.8 million and EEOC and Enterprise Florida agreed to engage in collaborative efforts to further strengthen Enterprise Florida’s hiring practices. Individuals received the Notice because they may be eligible to receive monetary relief as part of the Settlement.
Individuals who applied for and were denied a Management Trainee position in Florida from January 1, 2019, through December 31, 2023, and were age 40 or older at the time they were denied the position, must complete a Claimant Questionnaire to secure their status as a Claimant and be entitled to a share of the monetary relief. Individuals can complete a Claimant Questionnaire either online here or by completing the Claimant Questionnaire and returning via mail or email by June 8, 2026, to:

The Claimant Questionnaire will ask individuals to confirm that they are eligible for the relief (i.e., applied for and were denied a Management Trainee position in Florida from January 1, 2019, through December 31, 2023, and were age 40 or older at the time they applied for the position). Anyone who fails to complete the Claimant Questionnaire by June 8, 2026, will not be entitled to any monetary relief.
Later, the Settlement Administrator will notify eligible Claimants of the amount of their monetary award (if any). This process will take some time, and individuals should not expect to receive notification of the determination of a monetary award for at least three months after the Claimant Questionnaire deadline date. If EEOC determines that individuals are eligible for a monetary award, a second notification letter/ email will be sent to them which will include a release of claims and a W-9 that they must sign and return to obtain any monetary relief.
Pursuant to 29 U.S.C. 626(c)(1), the filing of EEOC’s lawsuit terminated the right of individuals to bring a new civil action against Enterprise Florida under the ADEA for the failure to hire claims alleged in EEOC’s lawsuit; therefore, you cannot bring your own suit or join a suit regarding these claims.
